1. Service Description

SendMonk provides managed hosting for the open-source application Listmonk, enabling users to send and manage email campaigns, including both promotional and transactional emails. Our services are offered on a subscription basis, with no free trials available.

2. Subscription and Payment

  1. Subscription Fee: Our service is available for ₹4,799 INR per month.
  2. Billing: Users are billed monthly, with payments collected through our payment providers.
  3. Refund Policy: If a user is not satisfied with the service, they may request a refund. Refunds will be processed on a case-by-case basis. Refund Policy

3. User Responsibilities

  1. Content Restrictions: Users are allowed to send both promotional and transactional emails. However, SendMonk is not responsible for the content sent via the platform, and users are solely responsible for ensuring compliance with applicable laws and regulations.
  2. Prohibited Uses: While there are no content restrictions enforced by SendMonk, users must refrain from using the platform for illegal activities or sending unsolicited emails in violation of anti-spam laws.

4. Data and Privacy

  1. Data Collection: We collect only the following user data:
    • Email address for account management.
    • Payment information, which is collected and processed securely by our payment providers.
  2. Third-Party Tools: SendMonk does not use any third-party tools for analytics, payments, or email delivery. All data is handled in-house.

5. Liabilities

SendMonk does not limit liability for downtime, data loss, or misuse of the platform. Users acknowledge that while we strive to provide reliable services, they use the platform at their own risk.

6. Account Termination and Suspension

  1. Non-Payment or Violation: In cases of non-payment or policy violations, SendMonk reserves the right to pause the user's hosted instance. We do not terminate user accounts but may suspend services until the issue is resolved.
  2. User-Initiated Termination: Users may terminate their accounts at any time without restrictions.

7. Intellectual Property

SendMonk does not claim ownership of the underlying Listmonk software, its branding, or its features. Our role is to provide managed hosting services for Listmonk. Any modifications or configurations made by users remain their property.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of India, specifically under the jurisdiction of Gujarat. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Gujarat, India.

9. Changes to Terms and Conditions

SendMonk reserves the right to update these Terms and Conditions at any time. Users will be notified of any changes via email or through announcements on the website. Continued use of the service after such changes constitutes acceptance of the updated terms.
